Press Release: Fight HST requests RCMP investigate BC Government HST web site

Vander Zalm: Elections BC will not hold government to account for violating Initiative Act, so we must.

Delta – Fight HST leader, Bill Vander Zalm, says he has asked the RCMP to conduct a formal investigation into a BC Government web site promoting the HST, after Elections BC refused to act on a complaint filed by his Fight HST team.

Vander Zalm says the BC Government is operating a web site promoting the HST that is clearly designed to counter the anti-HST petition.

The site link: http://hst.blog.gov.bc.ca/2010/03/31/view-all-videos/ contains a series of recently produced video advertisements designed to discredit the Initiative proponent.

Vander Zalm says the videos contravene the Initiative Act, as follows:

s. 31 – An individual or organization who wishes to oppose an initiative petition and intends to incur expenses in their opposition campaign must apply to register as either an opponent or as an initiative advertising sponsor.

The Initiative Act defines “advertising” as:
…any public promotional material including, but not limited to leaflets, lawn signs, billboards, brochures, buttons, badges, websites, newspapers, radio, television, newsletters and public address systems.

The Initiative Act defines “Initiative Advertising” as:
Advertising used during an initiative petition period to promote or oppose, directly or indirectly, the initiative petition or draft Bill, (in this case, The HST Extinguishment Act)

The Act also states:
s. 39 – No individual or organization may incur an initiative expense unless they are an authorized participant or a registered initiative advertising sponsor. Unauthorized individuals or organizations that incur initiative expenses are subject to significant penalties.

“Everyone knows the BC Government dropped the ball by not registering as an opponent. Now, we think they are breaking the law to try to get their message out,” said Vander Zalm.

Chris Delaney, Lead Organizer for Fight HST, says he made a formal complaint to Elections BC about the government HST web site, but that the legal team at Elections BC was unable to provide a satisfactory explanation for why they deemed the BC Government website as ‘outside the Initiative Act’.

Delaney says Elections BC had earlier ruled that a planned government information ‘mail out’ would be in violation of the Act. He says both “web sites” and the “mail outs” are classified as advertisements under the Initiative Act.

“We asked them to explain why a mail out extolling the tax was a violation, but a website with videos doing exactly the same thing was not. Their replies were unsatisfactory, since they could not explain specifically why the government website did not meet the definition of advertising under the act,” Delaney explained.
Elections BC spokesperson, Nola Western, replied to the Fight HST inquiry as follows:
“The Recall and Initiative Act does not define “advertising”. Rather, it defines initiative advertising as “…advertising used during an initiative petition period to promote or oppose, directly or indirectly, the initiative petition or draft Bill….” To provide guidance to advertising sponsors and other clients, Elections BC consulted with legal counsel and developed the definition of advertising included in The Guide to the Initiative Process. Although that definition does refer to websites, it does not imply that every website constitutes advertising.
Delaney responded, “Actually, in our opinion it does imply that every web site run by an opponent to the HST petition during the petition period constitutes advertising. Accordingly, we filed our complaint with the RCMP in the expectation that they will provide an objective, independent review of the matter.”

Vander Zalm says he has a concern that since former Chief Electoral Officer Harry Neufeld was denied an extension to his term after ruling against the government on the mail out, that the people now running Elections BC have been cowed into agreeing with the government for fear of reprisal.

“The 700,000 British Columbians who signed the petition deserve to know if there is one set of rules that apply to them, and another set of rules for the government,” concluded Vander Zalm.

Individuals responsible for violating the Initiative Act are subject to penalties up to ten times the cost of the advertising produced.

I commend you for following this up with the RCMP. But I fail to see how they will help. It is well known that they have dragged their feet consistently in matters involving the Basi-Virk/ BC Rail trial even suggesting that the public do the investigating for them and present the evidence.
I sincerely hope they wll investigate but I doubt it.

Campbell and gang didn’t like the first ruling and expect that this will not happen again. The lieberals again are taking, and have taken care of business.
In my opinion it is a clear contravention of the act.
Not surprised by this though.

As an owner of a shoe repair shop started by my family back in 1925 I must tell you the hst is not going to help small business as stated by the Liberal Government. We currently Charge the Gst on all the footwear we recycle by repair and pay the pst on all materials used. The Hst is simply taxing the labor to recycle the footwear. We as an industry gathered 9000 signatures previously showing the strong dislike felt by the people who chose to recycle by repair. Shame on the Government’s lack of thought in this process. I am sick and tired of our government not listening to us. Do they forget they work for us?
HST is to start in a few weeks. Can they really start it after our pitition has overwhelmingly said NO to it?

Factor’s such as “location, labour , access to supplies , access to market etc…

other “factor’s” include , demographic data on the customer’s , socialgraphic , geo-graphic , ect…!

A good example is: ” An out-door water park in BC’s north , isn’t a good idea because of the WINTER-LIKE-TEMPATURES” …!

and NOT taxation…!!!!!

If this is true that Harry Neufeld was denied an extension to his term , then he should be urged to come foward to the media on this, he has nothing to loose by doing so , and if the others at elections BC came foward this would simply expose Gordon Campbell fir the bully he is.

Btw, I love how we are being told we need to be educated as to the benefits of the HST, yet those videos are the same ridiculous points the government has mentioned from the beginning. I wonder how much of our money has been and will be spent on advertising the same points we’ve heard hundreds of times?

There’s seems to be corruption at every turn when it comes to Campbell and the HST. He’s washed up here in BC and he knows it. These are desperate moves by a desperate man trying to stay in power. Recall is not far off now and we the people of BC will prevail, not the big business Corporations. Stay the course Bill and Chris we can and we will prevail!

What about Colin Hansen’s appearance in plain clothes on the GlobalBC News in which he’s holding a package of Huggies Diapers and promoting the fact that HST will not apply to diapers? If that’s not a contravention of the Initiative Act, I don’t know what they term is!! I wonder if he got a kickback from the Huggies manufacturers? What a bunch of crap! Not to mention the promotion of the BC Gov’t Blog on Global BC news which is now the subject of the Request to the RCMP to investigate.

I have a 10 week old… I would rather pay the 7% on diapers (and get $2 off with a coupon anyway) than pay the extra 7% for everything else. The $1.40 I’ll save off a pack of diapers doesn’t compare to the hundreds of dollars the government will be getting from all the things that will have that extra 7% on them.
Anyone else notice that products to help you quit smoking will be subject to an extra 7%… and that taxes on liquor purchases are going down, but tax on cab fare is going up? Epic fail, Campbell!
How stupid do you think your constituents are? Trying to win over mommies with diapers and daddies with beer?

This is outrageous and should be stopped. Can we not get an injunction of some kind to stop this premier. I understand that all MLAs will be travelling the Province during the summer to bolster their hst campaign. Wonder what that cost will be? I am wondering if pressure cannot be applied to the one mla in the North to also resign from the Liberal party. They not only need to stop their advertising but they need to do so immediately! Why has the firing of Neufeld not been more public? First I have heard of it. Keep up the good work!!!!

Elections BC should also be investigated as they are supposed to be independent of government, and since the former Chief Electoral Officer Harry Neufeld term was not renewed it smacks of interference and coercion by the Campbell Liberals as retaliation for not towing the Liberal Party line, and that is wrong, and very likely illegal. I’m willing to bet that the legal opinions they received are ones from Liberal Party connected lawyers.

The only problem I see with this is the following:

So if the RCMP do deal with this, basically we the tax payer get to pay the government to pay it’s fine of up to ten times what it already wasted on it’s propaganda? I guess that’s one of Gordon’s favorite ways of wasting our money, like the appeal on his gag law.

This would be a great province if we had some honest politicians.

Who has been guarding the HST petitions since April 5?? Who will be scrutinizing the vote counting for the people of B.C.? Has Campbell been at the shredder yet AGAIN??

Mr. Campbell, must think nearly 700,000 voters are idiots, when it comes to his phony HST .. well he is in for a big surprise.

The People elected him as our Premier and we will certainly be quote ‘un-electing him”, in the near future.

Just tired of a Government, that does not care about the working person or small business man, does not know how to operate proper Budget Legislation and lies to the people.

The HST will be repealed just like Saskatchewan did … and the new future government, whoever that may be will understand and realize the ‘People come first, always have and always will”.

Thank you Canvassers and if we have to go for 40% – that will be very easy to obtain!

I am more disguisted everyday at what I hearing happening to this great country. My thoughts lately are and which Country would I like to move to and to be able to afford to live in, because I don’t think it will be Canada, that is if I have any money for air fare to escape that is!
And as far as that jerk Campbell, he would sell his kids for a buck.
I am proud of those who signed the petition and reached the 15%, but what about the rest of you, we should be at 100% ~ get off your butt the rest of you and stand up for your rights, before you have none at all,

To be honest, I am not surprised by this. I expected Campbell’s corrupt power to eventually get to Elections BC, who have now unfortunately chosen to become corrupt themselves.

Who can we TRUST? Elections BC has just been bought out by Gordon Campbell through threats and bullying!

The guy who did the right thing is now being punnished by essentially being terminated? WTF folks! This is insane!

It is official……Gordon Campbell is THE WORST PREMIER in the history of British Columbia!……Others do not even come close to the horrible things Gordon has done and is still in the process of doing.

What I really like is the fact that the BC Government site focuses on large corporations who will get the kickbacks and benefit from the small businesses that will be going out of business with the implementation of this Hated Sales Tax (HST). Of course they don’t touch on that but if you have any kind of intelligence you can certainly read between the lines.

They also don’t touch on the cost of the office supplies or computer repairs that you have to purchase/use for your business and how that will affect your bottom line.

They also don’t mention when these videos were actually recorded. How many of these people actually regret what they have said on those videos? or have said other things against the HST that was cut out? or have changed their opinions on the HST after learning more about the range of items being taxed?

Let’s keep putting the pressure on! We still have two weeks!

To safeguard the petitions, each sheet should be numbered and scanned before handing to Elections BC. Be sure to check the scan to make sure everything comes out properly. It will be a lot of work but necessary. With a high speed scanner, it should not take much more than a day. We don’t want to have some boxes “accidentally” missing.

After Terry Lake suggested lowering the rate on the HST in 2012, Campbell suggested increasing the rate and lowering income tax. Those people who can least afford it will be hit even harder [people who don't have to pay income taxes]. Campbell is already getting burnt to the crisp and he wants to add more wood to the fire?? That is not too bright.

I really thought we were going to defeat the HST because I forgot who we are dealing with, the man is a common criminal (I am not defaming anyone, I am just saying the truth). I guess we will just have to grin and bear it.
Gordon Campbell increases the taxes, so we won’t squawk about his salary increase.
The moral of the story is; DO NOT ELECT CRIMINALS TO POSITIONS OF GOVERN-MENTAL POWER. The saddest part of this fiasco is that the loudest complainers of this new tax, will be the people WHOM ELECTED THE CRIMINAL INTO OFFICE.
True I liked Gordon Campbell when he first arrived on the political scene but after just 1st term he started to show his true colours and lost my support from that point on. I know there will be a lot of complain-ing in the months ahead, which will turn into years but that is what the simple minded people who voted Gordon Campbell into the premier’s office deserve. Another way to summarize for those that voted him into office – “THEY MADE THEIR BED, NOW THEY HAVE TO LIE IN IT”. Unfortunately so do the rest of the people that live in this beautiful province, no matter HOW they voted.

I hope everyone is taking notice with this and seeing how “determined” the Campbell government is in “stuffing” this HST down everyone’s throats.

I vote to start the “Recall” and the “Injunction” process. Campbell and Hansen are going to fight this to the bitter end no doubt about that.

I have a problem with being ignored by the people I write to in Government offices. With some emails, I receive a ‘read’ receipt, most I don’t. Some, I receive a written response, most, I don’t. In the interest of ‘openness’, I have a suggestion.

Anyone with a government email address (any level of government) should be required to have their email programs send a “RECEIVED” receipt. That way no one can say they did not receive a certain email. Then, upon opening, their program should send a “READ” receipt. If, for whatever reason, the email is “DELETED UNREAD”, I should receive that message also. These very simple, and in my mind’ logical, steps would go a long way towards “Openness’ in Government”. Mind you, that pre-supposes that Government WANTS openness!

By November people will have had a taste of the HST, and all the phony baloney jargon from the Liberals about how the HST will create jobs and not cost the average person more money will be proved as the lies they are. I think it will be easier to recall MLAs than it was to get 700,000 signatures on the petition since some people were uncertain how the HST will affect them. They will know by November, and be as eager as us canvasers to pull the Liberals from power.

Campbell will fight tooth and nail to stay in office. There is no way he wants the citizens and other political parties, to learn just how badly, this province is financially ruined. Campbell and Hansen are busy plugging all the holes, where the truth may leak out. Blacking out FOI papers, to hide the Olympic debt. E-mails, regarding the corrupt sale of the BC Rail, went missing. Campbell has to control absolutely everything, the media, the newspapers, RCMP. The Judicial system. Any official such as Neufeld, who had to make his decision, within the law, certainly loses their jobs. I guess Hansen pitched a fit, and tattled to Gordo, that Neufeld, ruled against him, because of the law. However, Campbell, Hansen and the BC Liberal Party are full of, hate, spite, malice, vendetta’s, silly little juvenile mind games. They also, lied, deceived and cheated to win the election. And Gordo is real proud of that. Just wait until you go grocery shopping, some bottles of drinks, one size has the HST, the other one doesn’t. Milk is exempt, soy mild isn’t. The HST had to have been made up by a lunatic. I ended up, getting a carry basket, to throw all of the HST items out. And get this, guess who is going to drill off shore wells, off the BC coast, no other than BP. I shouldn’t post, I can’t keep my contempt down.
